A Mississippi man accused of killing his 9-month pregnant girlfriend has been released from custody pending trial.

Holmes County Sheriff Willie March tells the Clarion Ledger that Terence Sample bonded out Tuesday. He had been denied it three times before, but finally got out after a state appeals court asked the lower court to reconsider.

Sample is charged with the kidnapping and capital murder of McKayla Winston, who disappeared days before she was found dead along a county road on July 1. She was expected to give birth July 4. Authorities have not released the cause of death.

Prosecutors say the two met the night Winston was last seen.

District Attorney Akille Malone-Oliver has said Sample became mad after learning Winston wasn’t going to put the baby up for adoption. (AP)
